The Delhi High Court recently declined to entertain a public interest litigation (PIL) that sought an investigation by the National Investigation Agency (NIA) into a protest organized by the Cockroach Janta Party (CJP) on July 20. This protest was aimed at expressing dissent over the NEET-UG examination paper leak and other related grievances. The bench, consisting of Chief Justice DK Upadhyaya and Justice Tejas Karia, emphasized that any incidents of vandalism reported during the protest had already been brought to the attention of the relevant authorities, who are responsible for taking appropriate legal action. The court clarified that it is the prerogative of the central government to refer cases to the NIA, rather than the judiciary's role. Solicitor General Tushar Mehta, during the proceedings, suggested that the petitioner consider withdrawing the PIL, which led the petitioner to formally request the court for its withdrawal. Consequently, the court dismissed the PIL as withdrawn.
The petitioner, Satish Kumar Aggarwal, who previously held the position of vice president at the Akhil Bharat Hindu Mahasabha, raised concerns in the PIL regarding the involvement of various activists and political figures in the protest, as well as the potential participation of foreign-funded organizations. He argued that these factors cast doubt on the genuine intentions and objectives behind the protest. Aggarwal's petition called for a thorough investigation to determine whether any external entities were engaged in activities that could threaten public order, national security, or the integrity of India. The plea requested the court to issue directives for the registration of a First Information Report (FIR) and to ensure a comprehensive and impartial investigation into the events surrounding the protests. Furthermore, it sought the involvement of a specialized agency, such as the NIA, should the competent authority deem it necessary based on the evidence presented.
